TERMS OF SERVICE — MADARDZ (SHOP-GATEWAY.ONLINE)

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement between you ("Merchant" or "User") and AMOUZIANE ZAKARIA, operating under the commercial brand MadarDZ (https://shop-gateway.online and https://madardz.shop-gateway.online), registered as an Auto-Entrepreneur in Oran, Algeria (Card N°: 36272467). By accessing or using our platform, you agree to be bound by these Terms.

2. DESCRIPTION OF SERVICE

MadarDZ provides cloud-based e-commerce automation software, including unified messaging inbox management, AI-assisted order confirmation, SMS/WhatsApp notifications, and API integrations with shipping and courier companies.

3. ACCOUNT REGISTRATION & COMPLIANCE

• Users must provide accurate business and contact information during registration.
• By connecting Facebook Pages, Instagram accounts, or WhatsApp numbers to MadarDZ, you represent and warrant that you are the authorized owner/administrator of those assets and that your usage complies fully with Meta's Messaging Policies and Commerce Policies.
• Sending unsolicited spam, prohibited content, or fraudulent messages through MadarDZ is strictly forbidden and will result in immediate account termination.

4. PREPAID WALLET, BILLING & REFUND POLICY

• Usage-Based Credits: MadarDZ operates on a prepaid wallet / credit system. Credits are deducted based on actual platform usage (such as confirmed orders, automated messages, or API tasks) according to the pricing displayed on the dashboard.
• Refund Policy: Unused prepaid cash balances exceeding 2,000 DZD may be refunded upon request to the original payment source (BaridiMob / CCP / Bank Account) minus a 10% administrative processing fee, within 5 to 7 business days. Promotional or bonus credits are strictly non-refundable.

5. SERVICE AVAILABILITY & LIMITATION OF LIABILITY

While we strive for 99.9% uptime, MadarDZ relies on third-party infrastructure (including Meta APIs, telecom networks, and courier company servers). AMOUZIANE ZAKARIA (MadarDZ) shall not be held liable for indirect damages, delayed shipments by courier providers, or temporary outages caused by third-party API providers.

6. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria.
